Mobile Application Terms: These terms govern your use of the CutEngine mobile application.
General Terms
By downloading, installing, and using CutEngine, you confirm that you are in agreement with and bound by the terms of service contained in the Terms & Conditions outlined below. These terms apply to the entire application and any communications between you and Feeling Mindful Labs LLC.
Under no circumstances shall the CutEngine team be liable for any direct, indirect, special, incidental or consequential damages, including, but not limited to, loss of data or profit, arising out of the use, or the inability to use, the application, even if an authorized representative has been advised of the possibility of such damages.
License
Feeling Mindful Labs LLC grants you a revocable, non-exclusive, non-transferable, limited license to download, install and use the application strictly in accordance with the terms of this Agreement.
These Terms & Conditions are a contract between you and Feeling Mindful Labs LLC (referred to as “CutEngine”, “us”, “we” or “our”), the provider of the CutEngine application and associated services.
Definitions
- Company: when this policy mentions “Company,” “we,” “us,” or “our,” it refers to Feeling Mindful Labs LLC, (610 Terrell Hill Dr, Austin, TX 78704).
- Country: the United States.
- Device: any internet connected device such as a phone or tablet that can be used to use CutEngine.
- Service: refers to the service provided by CutEngine as described in these terms.
- You: a person or entity that has downloaded and uses CutEngine.
Health & Fitness Disclaimer
CutEngine provides calorie targets, macro recommendations, body composition estimates, and recovery assessments for informational purposes only. CutEngine is not a medical device and does not provide medical advice.
- Consult a physician before starting any diet or exercise program.
- Calorie and macro targets are estimates based on formulas and your data. Individual results may vary.
- Body fat estimates from tape measurements and calipers have inherent margins of error.
- Recovery scores based on sleep and HRV data are general indicators, not clinical assessments.
- Enhancement tier recommendations are based on general guidelines and should not replace professional medical advice regarding pharmaceuticals.
- Do not rely on CutEngine to make medical decisions or diagnose health conditions.
By using CutEngine, you acknowledge that all dietary and fitness recommendations are general in nature and you assume full responsibility for your health decisions.
Subscriptions and In-App Purchases
CutEngine offers auto-renewable subscription plans:
- Monthly Plan: $9.99 per month
- Annual Plan: $49.99 per year
Subscription Terms
- Payment will be charged to your Apple ID account at confirmation of purchase.
- Subscription automatically renews unless auto-renew is turned off at least 24 hours before the end of the current period.
- Account will be charged for renewal within 24 hours prior to the end of the current period at the rate of the selected plan.
- You can manage and cancel subscriptions in your Apple ID Account Settings after purchase.
- Any unused portion of a free trial period will be forfeited when you purchase a subscription.
- All subscription payments are processed by Apple. We do not have access to your payment information.
Free Trial
- CutEngine offers a 2-week free trial for new subscribers.
- The free trial automatically converts to a paid subscription at the end of the trial period unless cancelled.
- You may cancel during the trial at no charge through your Apple ID Account Settings.
Refunds
Refund requests must be directed to Apple through their standard refund process, as all payments are handled by Apple.
Restrictions
You agree not to, and you will not permit others to:
- License, sell, rent, lease, assign, distribute, transmit, host, outsource, disclose or otherwise commercially exploit the application or make it available to any third party.
- Modify, make derivative works of, disassemble, decrypt, reverse compile or reverse engineer any part of the application.
- Remove, alter or obscure any proprietary notice of CutEngine or its affiliates.
Third-Party Services
CutEngine integrates with the following third-party services:
- Apple HealthKit: For reading health and fitness data. Governed by Apple's HealthKit terms.
- BodySpec API (optional): For importing DEXA scan results. Governed by BodySpec's terms of service.
- Amazon (links only): Product links for measurement equipment. We are not affiliated with Amazon.
We are not responsible for the content, accuracy, or practices of third-party services.
Intellectual Property
The application and its entire contents, features and functionality are owned by Feeling Mindful Labs LLC and are protected by United States and international copyright, trademark, and other intellectual property laws.
Limitation of Liability
To the maximum extent permitted by applicable law, in no event shall CutEngine or its suppliers be liable for any special, incidental, indirect, or consequential damages whatsoever, including but not limited to damages for loss of profits, loss of data, business interruption, or personal injury arising out of or in any way related to the use or inability to use the application.
Termination
This Agreement shall remain in effect until terminated by you or CutEngine. We may suspend or terminate this Agreement at any time without prior notice if you fail to comply with any provision. You may terminate by deleting the application from your device.
Governing Law
This Agreement is governed by the laws of the United States and the State of Texas without regard to conflict of law provisions.
Changes To Our Terms
We may update these Terms from time to time. We will notify you of material changes through the app. Continued use after changes constitutes acceptance.
